Welcome to Focus Shift Creative (“we,” “our,” “us”). These Terms and Conditions (“Terms”) govern your use of our website, services, and any related products or content (collectively, the “Services”). By accessing or using our Services, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our Services.

By using our Services, you confirm that you are at least 18 years old (or the legal age of majority in your jurisdiction) and have the legal capacity to enter into this agreement. If you are using our Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

Focus Shift Creative provides creative media production, video and photography services, marketing consultation, and related creative solutions (“Creative Services”). Specific deliverables, timelines, and payment terms may be governed by separate written agreements or proposals between Focus Shift Creative and the client.

All content, materials, designs, images, videos, graphics, and text created by Focus Shift Creative remain our intellectual property unless otherwise agreed in writing.

• Clients receive a license to use delivered materials for the intended purpose outlined in the project agreement.
   
• Unauthorized reproduction, resale, or modification of our work is strictly prohibited

Clients must provide accurate information, materials, and feedback necessary for the completion of a project. Delays or inaccuracies caused by the client may affect project timelines and outcomes. Focus Shift Creative is not liable for such delays.

Unless otherwise agreed in writing:

• A non-refundable deposit (typically 50%) is required to begin any project.
   
• The remaining balance is due depending on retainer plan chosen
   
• Late payments may incur interest or additional fees.
   

All fees are stated in US Dollars, and clients are responsible for any applicable taxes.

If a client cancels a project after work has begun, Focus Shift Creative reserves the right to retain the deposit and charge for work completed to date.
Refunds are not provided after final deliverables have been approved or delivered.

To the maximum extent permitted by law, Focus Shift Creative shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the use of our Services or deliverables. Our total liability shall not exceed the amount paid by the client for the specific project.

We respect client confidentiality. Any proprietary or sensitive information shared during the course of a project will be kept confidential and used only for the purpose of fulfilling the agreement.

Unless otherwise stated in a written proposal, each project includes a limited number of revision rounds. Additional revisions beyond the agreed amount may incur extra fees. Client approval of final deliverables signifies acceptance of all work performed.

Focus Shift Creative reserves the right to suspend or terminate Services at any time if the client violates these Terms, fails to make payment, or engages in conduct that is abusive or unethical.
